Animal variance forms can be submitted to the WHOA by residents who have outside animals that are not dogs, cats, or a limited number of horses in the estates (all of which are already allowed by deed restriction in reasonable number if not creating a nuisance). A variance is needed if you have an animal other than dogs/cats/limited number of horses in the estates AND that animal is outside on your lot for more than 60 cumulative minutes per day.

There are animal variances and animal special variances.

A. Animal variances require a form submission attesting that the resident will follow the listed rules. They are currently available for the following animal types below (clickable links):

  1. ESTATES sheep and goats
  2. ESTATES equine
  3. ESTATES poultry
  4. CITY poultry (uses current Orange County residential zoning rules, and requires an OC permit in addition to WHOA variance)

B. Animal special variances are needed when the number of animals exceeds the allowances in the animal variances, or when seeking permission for an animal type not covered in the available animal variances. These require letters of no objection from all neighboring non-vacant properties, a site visit, and written approval by the WHOA Board.
